The New Attorneys Section of the SMCBA Estate Planning & Probate Section presents a luncheon with Court Research Attorney, Peter MacLaren. Peter is an experienced research attorney dealing with the numerous and interesting issues that are heard at the Probate Court. Peter will discuss topics of interest to attorneys new to the Probate Court process and provide tips for working effectively with the Probate Court Staff and the Court itself.

Learn how to tackle thorny issues involving state and city paid sick leave laws, including local ordinances in Emeryville, Berkeley, Oakland and San Francisco. This program will provide practitioners with a clear understanding of a variety of trust planning strategies (such as QTIPs, CRUTs, QPRTs, ILITs and Section 682 Support Trusts), will address the issues that often arise with these types of trust structures during the marital dissolution process, and will analyze how certain trusts can be used as a creative solution for the settlement of difficult or unusual divorce cases. In addition, this program will address the common question that often is a key factor in any settlement discussion—”Will it be enough?”

Please join the Family Law Section on Friday, March 8, 2019 for their annual panel discussion with the hearing officers of the San Mateo County Superior Court’s Family Law Division. This is a unique opportunity for the Members of the Family Law Section to engage with their very own San Mateo County Family Law Judges and Commissioners on a more informal basis and to ask some of the burning questions that generally cannot be answered from the Bench.

Members are encouraged to submit questions on any topic of general interest to the Family Law Section.  In past years, questions have ranged from Bench Officer preferences for courtroom practice and procedure, to understanding and application of recent changes in family law.  No case-specific hypotheticals please.  Please submit questions to be addressed at the panel discussion by no later than Friday, March 1, 2019.  This will allow the Judges and Commissioners sufficient time to adequately consider the Members’ questions or concerns.  Questions should be submitted to jward@bswmlaw.com. .

Please join the Labor & Employment Section on Thursday, February 28, 2019, for a presentation on Tax Consequences of Settlements and Judgments in Employment Matters by Julia Damasco.

Attorney Julia Damasco of Miller Kaplan Arase LLP in Half Moon Bay will be providing a presentation to update the section on the tax consequences of settlement agreements under the new tax laws. Julia Damasco is a tax attorney admitted to practice in California and Washington.  She has advised attorneys and litigants for over 20 years on the tax consequences of settlements and judgments.  Her articles on the subject have appeared in ABA and other publications.  She is a partner and member of the managing partner committee for the CPA firm of Miller Kaplan resident in the San Francisco office.  The chair of the IRS liaison committee for the National Association of Federal Equity Receivers, she has personally obtained over 20 rulings from the IRS and US Treasury on the tax consequences of settlements and judgments.  Her experience on employment matters includes the Microsoft Temporary Workers and the NCAA Coaches settlements; and her authorship of articles for the ABA and the Southern Poverty Law Center.  She is a member of the board of the San Francisco General Hospital Foundation and was a resident of San Mateo county for over 30 years.

Despite Professor Donaldson’s prediction during the Q & A session at Heckerling that final 199A Regs. would be delayed due to the shutdown, final 199A Regs. were issued (but not discussed) the last day of the 53rd Annual Heckering Institute on Estate Planning. So, in addition to covering as much as possible from the Institute, the speakers will cover post-Heckerling developments including 199A Regs., time permitting.

Topics will include: Basis, Powers of Appointment, Engagement Letters, Foreign Property Ownership by U.S. Persons, Charitable Planning, Insurance Planning, IRA Trusts, Divorce planning (after TCJA alimony change), Fiduciary Selection, as well as numerous significant rulings from 2018. This will be a fast-paced presentation as the speakers will attempt to compress 30+ hours of learning into 1+ hour.

Special Note: This will be a joint event, hosted by both the Peninsula Estate Planning Council and the SMCBA’s Estate Planning & Probate Section.
