Undue influence occurs when an older adult is coerced, threatened, manipulated or persuaded into making changes to their estate plan that they wouldn’t make if it weren’t for the undue influence. The perpetrator can be a family member, new romantic interest, caregiver, professional, or a friend. The undue influence is often not recognized until after the victim has died and the will is read.

Undue influence is not an event; rather, it is a psychological process that usually occurs behind closed doors. What are some of the red flags that might alert an attorney to the possibility of undue influence while the client is in the office?

This presentation will focus on what to look for when the client is present and what kinds of questions to ask and steps you can take if you suspect undue influence.
