Please join the Family Law Section on Friday, September 11, 2020, for a presentation by Tanya E. Prioste Esq., Elaina C. Serotte, CFP®, CDFA, and Ariella Goodwine Fisher, MFT about Collaborative Divorce.

Have you ever wondered about Collaborative Divorce, questioned how it works and how it helps families in a divorce?  Well, wonder no more. In this presentation, a lawyer, a financial expert and a mental health professional will give you the overview of what a Collaborative Divorce is, how it works, who’s involved and what’s expected of the clients. 

With this presentation, you will become educated about Collaborative Divorce as a process option for divorcing families so that you can inform your clients about all of their divorce process options and maybe even become involved in this process option yourself.

Tanya E. Prioste is a partner in the Family Law Group at Lakin Spears LLP and a Certified Family Law Specialist, certified by the State Bar of California Board of Legal Specialization. Her practice is devoted exclusively to family law. In addition to doing traditional divorce representation, Ms. Prioste is a mediator, acts as collaborative counsel in Collaborative Divorce cases and as a consulting counsel to mediations. She also prepares and negotiates premarital and postmarital agreements. Tanya is on the Board of Directors for Collaborative Practice California, and has also co-authored several articles and presented on numerous family law topics.

Elaina C. Serrotte is a Certified Financial Planner practitioner (CFP) and Manager at Parallel Advisors. Elaina has more than 17 years of experience in the financial services industry creating financial plans and wealth transfer strategies for individuals and families. As a Certified Divorce Financial Analyst, she works primarily with individuals through and post dissolution. Elaina works with family law counsel and their clients to organize information for their PDD’s, create cash flow analyses, portfolio analyses, and settlement strategies. She works as co-mediator, with attorney assisted mediation, on negotiated settlements and in collaborative divorce settings. 

Ariella Goodwine Fisher is a Private Practice Psychotherapist, Mediator, Parent Coordinator, Child Custody Evaluator and Collaborative Divorce Coach in San Mateo. She has been a frequent guest lecturer and trainer regarding mental health and addiction issues, and has extensive experience working with children and families going through the divorce process.

Due to continued Shelter-in-Place restrictions, this event will be hosted via Zoom.  Consistent with our prior virtual presentations that have qualified for MCLE credit, all attendees must register online prior to the event. The Zoom invite and materials for the event will be provided by the SMCBA prior to the event.

Please join the Family Law Section on Friday, February 14, 2020, for a presentation on Defining and Achieving Realist Financial Goals in Divorce by Clari Nolet CFP®, CDFA®

As a senior wealth advisor at Team Hewins, Clari works collaboratively with other advisors to provide comprehensive financial planning and investment advice to women in transition, individuals and families. In addition, Clari has published a number of articles, and has been quoted as an industry expert in the media. Clari will provide practical tools to help identify and improve clients interaction with money and financial planning through the use of effective financial habit formation.   Clari will also demonstrate the value of visualization in financial planning to understand the short- and long-term outcomes of the tough decisions necessitated by the divorce process. Understanding the interaction of the many variables that impact a clients specific financial situation is complex.   Visualization can be an effective tool to assist clients in making informed realistic decisions during divorce financial planning, often reducing immobilization and fear.   This course will cover specific examples of visualization, including, but not limited to; comparing 4 options for the family home, a lump sum settlement versus support over time and the significant impact of spending in the financial planning process.

Clari Nolet, is a Certified Financial Planner and a Certified Divorce Financial Analyst with Team Hewins in Redwood City.  She holds a B.S. in Chemistry from Saint Lawrence University and an M.B.A. in Finance from Suffolk University’s Sawyer School of Management.  Clari has focused her practice on assisting women in transition organize and build their financial lives by setting and supporting their goals as they reinvent themselves.  Clari routinely assists parties and counsel in family law cases develop realistic financial goals and a plan for attaining those goals.  She has worked with family law counsel both as a consulting and testifying expert.  Prior to joining Team Hewins, Clari worked with Wealth Architects in Mountain View and Opes Advisors in Palo Alto.

Estate Planner Liability for Transmutation Malpractice Arising Out of Divorce – Nov 21st

Please join the Estate Planning & Probate Section on Thursday, November 21, 2019, for a presentation on Estate Planner Liability for Transmutation Malpractice Arising Out of Divorce with John P. Golden, Esq. and Jennifer L. Mispagel, Esq.

The presentation will focus on Estate planning attorneys (and others) who often prepare transmutation agreements in connection with tax and estate planning for married clients.  This program will cover a myriad of problems caused by such agreements which usually arise during marital dissolution proceedings but can sometimes arise in the event of death of a spouse (or even in the creditor context).  The program will include tips on how to reduce (but not eliminate) the malpractice risk for the estate planner.

Presenter John P. Golden is a California Certified Specialist in Probate, Estate Planning & Trust Law in Hopkins & Carley.  With more than 35 years of experience in estate planning, John counsels clients on estate planning and administration of estates and trusts.

Presenter Jennifer L. Mispagel is an associate in Hopkins & Carley’s Family Wealth & Tax Planning Department. She represents individuals, families, trustees, executors and personal representatives in Estate Planning, Wealth preservation and transfers, and more.
