Jeniffer Alcantara, the ADR Program Manager of the San Mateo County Superior Court, will talk about the Court’s ADR program, new changes to the local rules, including informal discovery conferences and the new single direct assignment system, and other topics of interest to all attorneys who practice in the San Mateo County Superior Court.

“A Higher Calling” Book Launch – Nov 20th

The book A Higher Calling: A Review of the Judges and Lawyers Who Shaped the San Mateo County Courts, written by California poet and journalist John Aiello, will be presented to San Mateo County Bar Association members on Friday, November 20, 2020 at 10:00 a.m.

John Aiello’s book includes the San Mateo County’s early and rough political beginnings, biographies of the judges that have served here, the story of the courthouses, a review of the evolution of our court system, discussions with history makers of our current legal community and Judges, and profiles of lawyers of the SMCBA who rose to the Federal Branch and our local Appellate Courts.

Please join the Business Section on Wednesday, November 18, 2020, for a presentation by Neda Shapourian and Kimberly R. Simms about Cannabis Law.

This program will provide key insights into representing small businesses, seed funding, patient’s rights and negotiations with government offices in this exciting new area of law. The presenters will discuss vital information to anyone already in, or interested in pursuing, a commercial cannabis business or representing such a business.  

Neda Shapourian advises emerging and small businesses on corporate formation, seed fundraising, venture capital finance, and strategic exits. She founded the firm’s cannabis practice group in 2017 which supports both “touch the plant” and ancillary businesses on corporate structuring, licensing and regulatory compliance, commercial transactions, and strategic risk management. She serves as the Co-Chair of the Bar Association of San Francisco’s Cannabis, Alcohol, and Regulated Industries Barristers Section and frequently serves on panels to speak about legal issues facing the Cannabis community.

In her law practice, Kimberly R. Simms she has fought relentlessly for patients’ rights, negotiated with government officials to craft reasonable and effective regulations that allow for safe access, litigated complex land use and zoning cases, and advised hundreds of medical cannabis entrepreneurs.  Kimberly is a recognized expert in this emerging area of law.  She has taught courses and lead seminars which focus on how to comply with the ever-changing legal and regulatory requirements of the cannabis industry.  She is considered a trusted source by the media and has been interviewed by NPR, CNN and many San Diego media outlets.  Kimberly is a founding Board Member of the Alliance for Responsible Medicinal Access, San Diego’s leading cannabis chamber of commerce and political advocacy organization. Kimberly is also proud to serve as co-founder for the San Diego Chapter of Women Grow. Women Grow was created to connect, educate and empower the next generation of female cannabis industry leaders by creating programs and events for aspiring and current business executives.

Our speaker, Jeff Polsky, will discuss recent developments in that law and describe the pros and cons of such programs.

Jeffrey Polsky, is a co-chair of Fox Rothschild LLP’s Labor and Employment Department. He focuses his practice on business and employment litigation and counseling. He has 30+ years’ experience drafting workplace arbitration provisions, arbitrating employment cases, and representing clients in disputes relating to claims of discrimination and harassment, trade secret violations, wage and hour compliance, wrongful discharge, and breach of contract.

Szczepanik will discuss tax strategies and implications when settling a trust or estate dispute. Ryan J. Szczepanik is a Principal with HARTOG, BAER & HAND. Mr. Szczepanik is a California Certified Specialist in Estate Planning, Trust and Probate Law. He focuses his practice on trust and estate litigation. He has tried numerous matters in both California and federal courts.

Mr. Szczepanik graduated law school in 2003. From 2003 to 2012, he litigated trust, estate, and business disputes at large law firms, most recently at King & Spalding LLP in its Atlanta and San Francisco offices. He joined Hartog, Baer & Hand in 2012. His practice has been devoted exclusively to trust and estate litigation since that time. He became a Principal of Hartog, Baer & Hand in 2016.

Mr. Szczepanik has presented on trust and estate topics at organizations throughout California. He has authored numerous published articles on trust and estate topics. Mr. Szczepanik is a Member of the Executive Committee of the Trusts and Estates Section of the California Lawyers Association (TEXCOM). He is the Vice President of the East Bay Trusts & Estates Lawyers (EBTEL). He is a delegate to the Conference of California Bar Associations (CCBA). He serves as a Court Appointed Special Master and Referee for the Alameda County Probate Court.

Mr. Szczepanik is a 1999 graduate of Amherst College and a 2003 graduate of Emory Law School. While a law student, he received the Dean’s Award for Trusts & Estates.

Have you ever wondered about Collaborative Divorce, questioned how it works and how it helps families in a divorce?  Well, wonder no more. In this presentation, a lawyer, a financial expert and a mental health professional will give you the overview of what a Collaborative Divorce is, how it works, who’s involved and what’s expected of the clients. 

With this presentation, you will become educated about Collaborative Divorce as a process option for divorcing families so that you can inform your clients about all of their divorce process options and maybe even become involved in this process option yourself.

Tanya E. Prioste is a partner in the Family Law Group at Lakin Spears LLP and a Certified Family Law Specialist, certified by the State Bar of California Board of Legal Specialization. Her practice is devoted exclusively to family law. In addition to doing traditional divorce representation, Ms. Prioste is a mediator, acts as collaborative counsel in Collaborative Divorce cases and as a consulting counsel to mediations. She also prepares and negotiates premarital and postmarital agreements. Tanya is on the Board of Directors for Collaborative Practice California, and has also co-authored several articles and presented on numerous family law topics.

Elaina C. Serrotte is a Certified Financial Planner practitioner (CFP) and Manager at Parallel Advisors. Elaina has more than 17 years of experience in the financial services industry creating financial plans and wealth transfer strategies for individuals and families. As a Certified Divorce Financial Analyst, she works primarily with individuals through and post dissolution. Elaina works with family law counsel and their clients to organize information for their PDD’s, create cash flow analyses, portfolio analyses, and settlement strategies. She works as co-mediator, with attorney assisted mediation, on negotiated settlements and in collaborative divorce settings. 

Ariella Goodwine Fisher is a Private Practice Psychotherapist, Mediator, Parent Coordinator, Child Custody Evaluator and Collaborative Divorce Coach in San Mateo. She has been a frequent guest lecturer and trainer regarding mental health and addiction issues, and has extensive experience working with children and families going through the divorce process.

Do’s and Don’ts of FCS Mediation – July 10th

Please join the Family Law Section on Friday, July 10, 2020, for a presentation by Tanya Both and Lisa Bergman, LMFT, on tips and tricks for Family Court Services (FCS) mediation.

This is a unique opportunity for the Members of the Family Law Section to engage with the professionals intimately in charge of custody mediation services for the Court.  Our presenters will cover the following topics:

  1. FCS basics (common mistakes);
  2. Statutory bases for mediation services;
  3. Tips for preparing clients for FCS mediation; and
  4. COVID-19 related updates for FCS mediation.

Lisa Bergman is a licensed Marriage and Family Therapist with a Master’s Degree in psychology.  She began working for FCS in 1988 for the Superior Court of California, Riverside County.  In addition to working for the Court, she has worked in private practice, for non-profit agencies, county mental health, and hospitals, both in-patient and outpatient services, providing family, marriage and individual therapy for adults, teenagers and children.  She has taught psychology for community college as an associate instructor.  In 2011, she graduated from Queen’s University Belfast with a Master’s Degree in Political Psychology.  Upon her return to the United States, she worked as the Director of Family Court Services for the Superior Court of California, Butte County.  In 2015, she began her current position as Supervising Child Custody Recommending Counselor for the Superior Court of California, San Mateo County.

Tanya Both worked as a family law and medical-legal partnership attorney before joining the Family Law Facilitator’s office in 2012.  In 2019, she joined the Superior Court of California, San Mateo County as Managing Attorney for FCS, the Family Law Facilitator’s office, Alternate Dispute Resolution (ADR), and the Probate Court Investigators.

One hour of MCLE Credit will be provided for attendance.

Please join the Family Law Section on Friday, June 12, 2020, for a live webinar about family law appeals, with leading certified appellate specialist Robert A. Roth, Esq.

Robert will present to the Family Law Section a program focusing on what family law attorneys can do at the trial court level to set the stage for a successful appeal. Robert’s insights will give practitioners guidance for avoiding missteps that can have an impact on a potential appeal, and also tips on measures that can be helpful for future modification proceedings.

With over 30 years’ experience as an appellate practitioner and more than 25 published appellate opinions that bear his name, Robert A. Roth is widely regarded as one of the leading family law appellate specialists in California. He has won twice in the California Supreme Court, and represented the successful respondent in In re Marriage of Ostler and Smith (1990) 223 Cal.App.3d 33, which established the method California courts use to calculate division of bonus income.

Robert was one of the first attorneys in California certified as an appellate specialist by the State Bar, and he has remained a certified appellate specialist for more than two decades. In addition to family law appeals, Rob has substantial experience handling probate, real property, business transaction, tort insurance, admiralty, and State Bar appeals.
